BOOK: 27
DECISION: 881
MONTH-YEAR: May - 2014
IN RE: C.Z.
APPELLANT: Parents of C.Z.
APPELLEE: [] CSD and Northwest AEA
KEYWORDS: Dual Enrollment for Special Education
FULL TEXT: https://www.educateiowa.gov/documents/special-education/2016/08/book-27-decision-881
DETAILS: A Complaint was filed by the parents of a child with a disability alleging violations of the Individuals with Disabilities Education Act (IDEA) by the childs resident school district and AEA.
The Respondents filed a motion for summary judgment, alleging that the issues raised in the complaint were moot because the parents opted to home school the child and declined dual enrollment for special education services.
Decision held that the childs parents had voluntarily withdrawn him from the school district and revoked consent for special education services.  The school district and AEA were no longer responsible for providing special education services, no compensatory relief was requested, and the relief that was requested was beyond the scope of relief available under the IDEA.
OUTCOMES: The Respondents prevailed and the complaint was dismissed in its entirety.
