DETAILS: Complaint filed by parent of high functioning student with multiple diagnoses, including Asperger Syndrome, was unilaterally placed by parent in private boarding school that specializes in educating students with disabilities similar to the students, after the student was not selected to participate in a competitive extracurricular activity.   
  Parent sought reimbursement of educational costs, alleging that the public school district could not provide a free appropriate public education because the student was is a state of emotional crisis so severe that the student needed to be educated in an intense therapeutic environment.

  The Respondent school district and AEA prevailed on all issues.   
  School district provided a free appropriate public education (FAPE) to the student in the past and offered an individualized educational program (IEP) sufficient to provide the student with FAPE during the upcoming school year.
OUTCOMES: Complainant failed to establish that students emotional state was such that student could not return safely to the public school.
